Terms of Service

Effective Date: March 8, 2026

Welcome to StreamerStats ("StreamerStats," "we," "us," or "our"). StreamerStats is a streaming analytics platform that provides data and insights for live streaming platforms including Twitch and Kick. The "Service" refers to the StreamerStats website, applications, APIs, and all related features and functionality. "You" and "your" refer to you, the individual accessing or using the Service. By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Agreement to Terms

By accessing the Service or creating an account, you acknowledge that you have read, understood, and agree to be bound by these Terms. You represent that you are legally capable of entering into binding agreements. If you are under the age of 13, we recommend parental guidance when using the Service. Your continued use of the Service following any changes to these Terms constitutes acceptance of those changes.

2. Description of Service

StreamerStats is a streaming analytics platform that aggregates and presents publicly available data from Twitch and Kick. The Service includes, but is not limited to:

  • Channel and streamer leaderboards and rankings
  • Channel profiles with detailed performance metrics
  • Public chat message logs and chatter statistics
  • Category and game analytics
  • Real-time platform metrics and viewer counts
  • Stream history, session data, and timeseries analytics
  • Search and discovery tools for channels and categories

The Service is currently provided free of charge. We may introduce paid features or subscription plans in the future (see Section 11). We may also expand the Service to include additional streaming platforms beyond Twitch and Kick.

3. User Accounts

  • Registration: To access certain features, you may create an account using an email address and password, or by linking a third-party account through OAuth (such as Twitch or Kick). You agree to provide accurate and complete information during registration.
  • Email Verification: All accounts require email verification before full access is granted. Accounts created via OAuth with a verified email from the provider are automatically verified.
  • OAuth Permissions: When you link a third-party account, you authorize us to access the information permitted by that provider's OAuth scope. We only request permissions necessary for account functionality.
  • Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
  • Rate Limiting: To protect the Service, login attempts are rate-limited to 5 attempts per minute. After 10 consecutive failed attempts, your account may be temporarily locked for 15 minutes.
  • Suspension: We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these Terms (see Section 16).

4. Acceptable Use & Prohibited Conduct

You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations. You shall not:

  • Engage in activities that could harm, disrupt, or overburden the Service, its infrastructure, or interfere with any other user's experience
  • Attempt to circumvent, disable, or interfere with security measures, including Proof-of-Work challenges, request signing, rate limiting, or fingerprinting systems
  • Impersonate any person or entity, or falsely represent your affiliation with any person or entity
  • Harass, threaten, or abuse other users of the Service
  • Upload, transmit, or distribute any malware, viruses, or other harmful code
  • Reverse-engineer, decompile, or disassemble any part of the Service, except as permitted by applicable law
  • Use the Service to send unsolicited communications or spam
  • Create multiple accounts to evade bans, suspensions, or security measures
  • Use the Service for any unlawful, fraudulent, or malicious purpose

5. Third-Party Platform Data

StreamerStats aggregates publicly available data from third-party streaming platforms, including Twitch (operated by Twitch Interactive, Inc.) and Kick (operated by Kick.com). You acknowledge and agree that:

  • StreamerStats is not affiliated with, endorsed by, or sponsored by Twitch, Kick, Amazon, or any other streaming platform
  • All trademarks, service marks, and logos of third-party platforms are the property of their respective owners
  • Data displayed on the Service is sourced from publicly available APIs and publicly accessible information provided by these platforms
  • The availability and completeness of data is subject to changes in third-party platform APIs, terms of service, and data access policies, which are beyond our control

6. Data Accuracy Disclaimer

Analytics, statistics, and other data provided through the Service are offered "as-is" for informational purposes only. While we strive to present accurate information, data may be delayed, incomplete, or contain errors due to the nature of real-time data aggregation. You acknowledge that:

  • Analytics data should not be relied upon as the sole basis for business, financial, or professional decisions
  • Historical data may be revised, corrected, or recalculated as improved methodologies are applied
  • Real-time metrics are approximations and may differ from data reported directly by streaming platforms
  • Temporary data gaps or inconsistencies may occur during platform outages, maintenance, or API changes

7. Security Measures

To protect the integrity of the Service and its users, we employ automated security measures on all requests to the Service. By using the Service, you consent to the following:

  • Proof-of-Work Challenges: Your browser may be required to solve computational challenges to verify that requests are made by legitimate users
  • Request Signing: Requests to the Service are cryptographically signed using HMAC to prevent tampering and replay attacks
  • Device Fingerprinting: We collect device and connection characteristics, including TLS fingerprints (JA3/JA4), browser properties, and hardware signals to identify and distinguish devices
  • Behavioral Analysis: Request patterns, timing, and usage behavior are analyzed to detect automated or abusive access
  • Rate Limiting: Requests are subject to rate limits to prevent abuse and ensure fair access for all users
  • Risk Scoring: Each request receives an automated risk score that determines whether access is granted, challenged, delayed, or blocked

8. Privacy & User Controls

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the practices described in the Privacy Policy.

We provide privacy controls that allow registered users to manage their visibility on the platform. Through your account settings, you may:

  • Opt out of having your chat activity displayed in public channel chat logs
  • Opt out of appearing in search results and chatter leaderboards

Privacy preference changes take effect within approximately 60 seconds due to caching.

9. Intellectual Property

  • Our Content: All original content, design, software, and code comprising the Service is the property of StreamerStats and is protected by applicable intellectual property laws
  • Third-Party Content: Streamer names, channel data, logos, and other content originating from third-party platforms remain the property of their respective owners
  • Permitted Use: You may reference or share StreamerStats content for non-commercial purposes with appropriate attribution. You may not use our branding in any manner that implies endorsement by or affiliation with StreamerStats without prior written consent

10. API & Data Access

Automated access to the Service is prohibited without prior written authorization. You shall not:

  • Scrape, crawl, or use automated tools to extract data from the Service
  • Use bots, scripts, or other automated means to interact with the Service
  • Bulk download, mirror, or systematically retrieve content from the Service
  • Bypass, circumvent, or disable any security measures or access controls

We may offer an official API in the future with separate terms of use. Violations of this section may result in immediate blocking of your access and may subject you to legal action.

11. Future Paid Features

We may introduce premium features, subscription plans, or other paid offerings in the future. Any paid features will be clearly identified with pricing information before purchase. Additional terms and conditions may apply to paid features at the time of their introduction. Currently free features may be modified, limited, or transitioned to paid offerings with reasonable notice to users.

12. Disclaimers & Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, error-free, secure, or free of harmful components. We make no representations regarding the accuracy, reliability, or completeness of any content or data provided through the Service.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STREAMERSTATS AND ITS OPERATORS, AFFILIATES, AND CONTRIBUTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE TOTAL AMOUNT PAID BY YOU TO STREAMERSTATS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless StreamerStats, its operators, affiliates, and contributors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use or misuse of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content you submit or transmit through the Service.

14. Dispute Resolution

  • Informal Resolution: Before initiating any formal proceedings, you agree to first contact us at [email protected] and attempt to resolve the dispute informally for at least thirty (30) days
  • Binding Arbitration: If informal resolution fails, any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted in the State of North Carolina
  • Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action
  • Exceptions: Either party may seek injunctive or other equitable relief in a court of competent jurisdiction for claims related to intellectual property rights or unauthorized data access

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions. For any disputes not subject to arbitration under Section 14, the state and federal courts located in North Carolina shall have exclusive jurisdiction.

16. Termination

  • By Us: We may terminate or suspend your access to the Service at any time, with or without cause and with or without notice, including for violation of these Terms
  • By You: You may terminate your account at any time through your account settings or by contacting us at [email protected]
  • Effect of Termination: Upon termination, your right to access the Service ceases immediately. We may retain your data as required by applicable law or legitimate business purposes
  • Survival: Sections relating to intellectual property, limitation of liability, indemnification, dispute resolution, and governing law shall survive termination

17. Modifications to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on the Service with a revised effective date. For material changes, we will make reasonable efforts to notify you via the Service or by email. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. The Service itself may also be modified, updated, or discontinued at any time without prior notice.

18. Severability

If any provision of these Terms is found to be invalid, unenforceable, or illegal by a court of competent jurisdiction, such provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms applicable to paid features, constitute the entire agreement between you and StreamerStats regarding your use of the Service. These Terms supersede all prior agreements, understandings, and communications, whether written or oral, relating to the subject matter herein.
